Communication from the Ministère des Forets, de la Faune et des Parcs – June 11, 2020
It has been brought to our attention that there is traffic on closed bridges located on the territory of the MRC. Several vacation lots and lakes appear to be accessible only via these bridges. The bridges and leases are identified in the documents attached to this correspondence. All users must comply with the laws and regulations in force, including, in the case of closed bridges, sections 42 and 233 of the Act respecting the sustainable development of forest land as well as section 117 of the Regulation respecting the sustainable development of forests, which states that :
An Act respecting the sustainable development of forest land
42. Any person may travel on a multi-use roadway in compliance with the standards prescribed by government regulations for user safety and road protection.
233. Every person commits an offence and is liable to a fine of $500 to $10,000:
(3) any person who fails to comply with a restriction or prohibition on access to a multi-use roadway imposed by the Minister under the second paragraph of section 42.
Regulation respecting sustainable forest management
117. Every person authorized to construct or improve a bridge shall, upon completion of such work, post at each end of the bridge the following items: Danger markers indicating the limits of the bridge deck; the indication of narrow passages; the maximum load that the bridge can support according to the type of vehicle and the speed allowed to cross it. The same applies to the person rebuilding a bridge.
All road signs and signals must be carefully installed, facing the vehicles, in such a way that they are clearly visible even at night. No obstacle, such as vegetation or a snow bank, should reduce their visibility. They must comply with the standards of the Guide de signalisation routière sur les terres du domaine de I ‘état, produced by the Minister responsible for the application of the Act respecting sustainable forest management (chapter A-18.1).
No vehicle whose gross vehicle weight exceeds that posted on the site in application of the first paragraph may travel on a road bridge.
The MFFP could issue notices of non-compliance to offenders during the next season. In addition, we remind you that any person who does not comply with the regulations in force may be liable to prosecution.
